Understanding Sex Crimes in Southern Nevada

Nevada law protects victims of sexual assault from harassment, intimidation, psychological trauma, and the unwarranted invasion of their privacy by prohibiting the disclosure of their identities to the public.

Sexual Assault Penalties

A person who subjects another person to sexual penetration, or who forces another person to make a sexual penetration on himself or another, or on a beast, against the will of the victim, or under conditions in which the perpetrator knows, or should know that the victim is mentally or physically incapable of resisting, or understanding the nature of his conduct, is guilt of sexual assault.

If substantial bodily harm to the victim results from the actions of a defendant committed in connection with, or as part of the sexual assault, imprisonment in the state prison will result:

  • For life without possibility of parole, or
  • For life with the possibility of parole, with eligibility for parole beginning when a minimum of 15 years has been served.
  • If the crime results in substantial bodily harm to a child, imprisonment in the state prison for life without possibility of parole is expected.
  • If the crime does not result in substantial bodily harm to a child, imprisonment in the state prison for life with the possibility of parole, with eligibility for parole beginning when a minimum of 25 years has been served.

Other sexual offense against a child means any act committed by an adult upon a child constituting:

  • Incest
  • Lewdness with a child
  • Sado-masochistic abuse
  • Luring a child using a computer, system or network is punished as a felony
